These Terms of Service ("Terms") govern your access to and use of Gymscape, including our website, web application, mobile applications, and related services (collectively, the "Service").
Gymscape is operated by Bogey Games LLC, a Wyoming limited liability company ("Bogey Games," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use Gymscape.
Gymscape provides fitness-related, game-based content, which may include general fitness activities, challenges, game mechanics tied to physical activity, and personalized recommendations based on user-provided inputs.
Gymscape is not a medical service. We do not provide medical advice, diagnosis, or treatment.
Physical activity involves inherent risks.
By using Gymscape, you acknowledge and agree that:
You are solely responsible for your health and physical condition
You should consult a physician before beginning any fitness program
You must stop using the Service immediately if you experience pain, dizziness, or discomfort

Certain features of the Service require an account.
You agree to:
Provide accurate, current, and complete information
Maintain the security of your account credentials
Accept responsibility for all activities that occur under your account
We may support multiple authentication methods, including email/password and third-party login providers.
The Service may allow you to create, post, or share content, including profiles, usernames, avatars, messages, and participation in challenges, leaderboards, or other social features ("User Content").
You retain ownership of your User Content. However, by using the Service, you grant Bogey Games a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content solely in connection with operating and improving the Service.
You agree not to submit User Content that is unlawful, harmful, abusive, misleading, or infringes on the rights of others.
Gymscape may offer paid features, including subscriptions and in-app purchases.
Payments are billed in advance
All payments are non-refundable, except where required by law
We reserve the right to change pricing, features, or availability at any time
Failure to pay may result in loss of access to paid features.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.
You may not:
Copy, modify, or reverse engineer the Service
Exploit bugs, loopholes, or vulnerabilities
Resell, sublicense, or commercially exploit the Service
Use the Service for unlawful purposes
We reserve the right to suspend or terminate your account at our sole discretion, including if we believe your conduct:

Violates these Terms
Is contrary to the spirit or intended use of the Service
You may delete your account at any time through the app.
You expressly acknowledge that physical activity carries inherent risks and that you voluntarily participate at your own risk.
To the maximum extent permitted by law, Bogey Games LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages.
Our total liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.
You agree to indemnify, defend, and hold harmless Bogey Games LLC from any claims, liabilities, damages, losses, or expenses arising from:

Your violation of these Terms
Your interaction with other users
Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, rather than in court.

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict-of-law principles.
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
